Civil Partnership Challenge

A decision is awaited from the High Court in respect of a legal challenge against the ban on members of the opposite sex entering into civil partnerships. A heterosexual couple have taken a case to the High Court in a legal challenge against the ban on members of the opposite sex entering into civil partnerships. It is alleged that section one of the Civil Partnership Act which require the partners are of the same sex is discriminatory and is therefore not compatible with Article 14 of the European Convention of Human Rights. The challenge is being led by a couple who do not believe in marriage and wanted to secure legal recognition for their relationship through civil partnership. The case has been heard over a course of two days in the Royal Court of Justice and Judgement is expected to be given within the next month.
